1. Application

1.1. Except where expressly indicated to the contrary, these Terms and Conditions apply to all products purchased from the Museum of Australian Democracy (MoAD) Online Shop. Please read these Terms and Conditions before confirming your Order.

1.2. By purchasing products you agree to be legally bound by these Terms and Conditions.

1.3. MoAD may amend these Terms and Conditions from time to time, and the amended Terms and Conditions will apply to all purchases made after we have published them on this website.

2. Pricing

Pricing and product descriptions

2.1. All prices quoted are in Australian dollars and are Goods and Services Tax (GST) free.

2.2. MoAD accepts the following payment methods: Visa and MasterCard, in Australian dollars only.

2.3. Payment of the correct price must accompany all orders. MoAD takes all reasonable care to ensure that all product details and prices on the MoAD website are correct at the time of online publication. Product details and prices are subject to change without notice in relation to future sales.

2.4. Sale and promotional product offers are only available at the lower price whilst the allocation lasts and during the designated sale period. MoAD reserves the right to withdraw any offer at any time.

2.5. Online pricing may differ from prices for identical or equivalent products in MoAD's physical shop.

3. Ordering

Ordering process

3.1. The sale of all products is subject to availability and any details on the online order form.

3.2. When you make an order you must use the online order form and provide all required information.

3.3. Once MoAD has received full payment, you will receive a confirmation email confirming the purchase to the email address supplied. MoAD will not be responsible for any errors in this information.

Sizing, colouration and imperfections

3.4. Although MoAD endeavours to accurately display sizes and sizing charts, size information is provided as a guide only.

3.5. Although MoAD endeavours to accurately display colours, your monitor may display colours slightly differently. This colour variation is not a fault and does not entitle you to a refund or exchange.

3.6. Products which are handmade or have components made from organic materials often contain small imperfections or variations. These will often differ from the product images.

4. Delivery

Postage

4.1. Postage costs will generally depend on the products ordered and the delivery method selected, unless a flat rate is imposed at MoAD’s discretion.

4.2. MoAD uses a third party provider, Sendle, to send orders domestically. MoAD's Online Shop is not liable for any missing orders and is unable to refund orders lost in the post.

Delivery timing

4.3. Orders are typically dispatched within five weekdays of purchase.

4.4. Orders may be delayed due to unexpected demand or restocking issues.

4.5. Sendle will provide notification email and tracking details after your order is dispatched.

5. Products - refund/exchange policy

Cancelled orders

5.1. MoAD reserves the right to cancel orders at any time (for example, due to unavailability or an error in the product description). If this occurs, MoAD will contact you via the email address provided to organise a refund or exchange.

Refunds and returns

5.2. MoAD is not required to refund the product price on the grounds that a product has not met your expectations, you have changed your mind or made a mistake in your order. Therefore, please choose your products carefully, and check your order details before making payment.

5.3. MoAD acknowledges that in the event of any misleading or deceptive representation by MoAD, defective product or incorrect order, you have rights under the Australian Consumer Law (ACL). Where you have rights under the ACL, MoAD will refund, credit or exchange purchases (including delivery/packaging costs) at its election, unless you are entitled to a particular remedy under the ACL.

5.4. Returns should include a copy of your proof of purchase, and be addressed to The Museum of Australian Democracy at Old Parliament House, PO Box 3934 Manuka ACT 2603. Refunds will be made to the credit card account used to place the order.

6. Secure payments

6.1. Payment is processed immediately with your product purchase.

6.2. To ensure protection of your credit card details, credit card payments are processed using a secure, third party payment gateway service run by Braintree – A PayPal Service, in Australian dollars only. Credit card details are encrypted and cannot be accessed by MoAD.

6.3. Details about our secure payment partner, Braintree, can be found on the Braintree website.

6.4. While MoAD contracts with a service provider to provide a secure system, MoAD does not and cannot take responsibility for the security of information during transit over the internet.

7. Personal information

7.1. MoAD uses a third party provider, Roller, to collect personal information when you purchase products. This information is collected for the purposes of fulfilling your order and providing you with any requested MoAD newsletters or requested promotional information.

7.2. MoAD may disclose your personal information to Sendle (MoAD’s courier) for the purposes of delivering your order. MoAD also securely retains your order details (but not credit card details) to help manage potential returns, refunds and exchanges.

7.3 MoAD may disclose your personal information to Knight Shift (MoAD’s print-to-order t-shirt manufacturer partner) for the purposes of producing and delivering your order.

7.4. MoAD collects and uses your personal information under the terms of MoAD's Privacy Policy. This Privacy Policy includes details about how you can make complaints about MoAD or access and correct your personal information. You must read this Privacy Policy.

8. Liability and law

Exclusion and limitation of liability

8.1. To the extent permitted by law, MoAD excludes all liability to any person for loss or damage of any kind (however caused, including by negligence) in connection with supplying or failing to supply products via MoAD’s Online Shop (including due to interruptions to the platform for any reason).

8.2. During website maintenance, we cannot guarantee the availability of the Online Shop or the integrity of any information submitted or retrieved during maintenance windows, and you acknowledge that if you access our online services during website maintenance you do so at your own risk.

8.3. Where any law imposes a non-excludable guarantee relating to these Terms and Conditions, then to the extent permitted by law, MoAD’s liability for breach of the guarantee will, at MoAD’s election, be limited to re-supplying the purchased products(s), or paying the cost of re-supply.

The governing law is the ACT

8.4. In purchasing products via MoAD’s Online Shop, you agree that the laws of the Australian Capital Territory govern the terms of that purchase and you submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory.
